This matter was before the Supreme Judicial Court on an appeal from a judgment denying the defendant’s petition for relief under G.L. c. 211, § 3, from a ruling of the trial court.  The defendant’s petition sought to continue a probable cause hearing on the Commonwealth’s petition that he was a sexually dangerous person.  Before the SJC could rule, the trial court dismissed the Commonwealth’s petition upon a finding by two qualified examiners that the defendant was not sexually dangerous.  Thus, the denial of the defendant’s motion for a probable cause hearing was moot, and the SJC denied the defendant’s appeal.
